In addition to disciplinary sanctions, the WAMU Banking Commission may impose financial penalties whose amounts shall be set by instruction of the Central Bank. The corresponding amounts shall be collected by the Central Bank.
Financial penalties may only be imposed in cases where a disciplinary penalty has been issued.
The maximum financial penalty that the WAMU Banking Commission may impose on a regulated institution shall be established by an Instruction of the Central Bank. This maximum amount may vary depending on whether the entity concerned is a credit institution, a financial company, an electronic money institution or a microfinance institution. The aforementioned Central Bank Instruction classifies violations into three categories and sets the quantum of the sanction based on which category the regulated institution falls under. In the event of multiple violations requiring multiple financial penalties, the aggregate amount of such penalties may not exceed the maximum amount set by the Central Bank.
The procedure for collecting financial penalties has been defined by the Central Bank, according to the category of regulated institutions. The procedure shall vary depending on whether or not the institution concerned holds an account with the Central Bank. Only credit institutions have such accounts.
